Terms and Conditions
These terms and conditions create a contract (the “Agreement”) between you (“Consignor”) and La Segunda, LLC, a limited liability company.
AGREEMENT
1. Agreement: This Agreement governs Consignor’s use of La Segunda’s services and property resulting from Consignor’s rental of a clothing rack at any of la Segunda’s locations. La Segunda reserves the right to refuse access or service to any La Segunda location, a Consignor’s online La Segunda account, or a Consignor’s ability to book a Rack, or sell items for an already reserved Consignment Period. Refusal of service does not guarantee any refund.
2. Consignment Period: The Consignor may house his/her/their inventory at La Segunda for a period of one (1) week at a time, which shall run from the respective Saturday at 9:00 a.m. to the following Friday, at 7:00 p.m. (the “Consignment Period”). Consignor may request to rent a rack or racks for consecutive Consignment Periods, but La Segunda reserves the right to restrict the number of consecutive Consignment Periods any individual person may book. Consignor must show up between 9am and 11am on Saturday beginning their Consignment Period. If Consignor does not show up and has not contacted the store by end of day Saturday, La Segunda reserves the right to book a new Consignor in the Rack for the remainder of the week, with no compensation given to the original Consignor. Additionally, if contact has been made, Consignor must commit to and setup no later than 12pm on Tuesday, otherwise La Segunda may exercise Its option to fill or reassign the Rack however La Segunda so chooses.
3. Duration of Agreement: This Agreement shall govern the entire duration of time during which Consignor’s inventory is housed by La Segunda.
4. Consignment Commission: On net sales of Consignor’s inventory items, La Segunda agrees to pay Consignor 60% commission (the “Consignment Commission”). Starting September 13, 2025 and going forward, La Segunda will pay the Consignor 60% commission (the “Consignment Commission”). La Segunda reserves the right to alter the Consignment Fee at any time and any such alteration will be reflected on La Segunda’s website. The net sales amount of the Consignor’s inventory items sold multiplied by the Consignment Commission, less any Fees as applicable, will be distributed to Consignor’s provided Venmo/Cashapp/Zelle handle. No sales report will be provided or available.
5. Venmo: The Consignor takes on full responsibility to correctly provide their Venmo handle when registering. The Consignor waives any right to demand payment if they have not provided La Segunda their correct Venmo handle and La Segunda pays the wrong person because of the Consignor’s mistake. In the event the wrong person is paid, it is the Consignor’s sole duty and responsibility to request the funds from the Venmo handle he/she/they incorrectly provided. La Segunda will not liaison this interaction and does not provide additional Venmo info for Consignors.
6. Rack Number: Upon acceptance of this Agreement, La Segunda will assign a rack number or numbers to Consignor for the Consignment Period. In the event Consignor requests subsequent Consignment Periods, La Segunda does not guarantee that Consignor will be assigned the same rack(s) for such subsequent Consignment Periods. In the event that Consignor books a rack, or multiple racks, for one (1) or more consecutive Consignment Periods, Consignor agrees to restock and/or Setup his/her/their Rack(s) at the beginning of each Consignment Period, and ONLY at the beginning of each booked Consignment Period.
7. Inventory Pricing: The prices charged for inventory items provided by Consignor are determined by Consignor and must be clearly displayed on tags that are securely attached to each inventory item.
8. Setup of Rack: Consignor must set up his/her/their assigned Rack(s) on the first day of the Consignment Period, which is Saturday, between 9 a.m and 11 a.m. local time. Each inventory item must be clearly and distinguishably tagged with both Consignor’s assigned rack number and the price of the item. La Segunda reserves the right at its sole discretion to sell or not sell any untagged inventory items. La Segunda also reserves the right at its sole discretion to take down or refuse sale of any items or racks that are deemed to not be in line with these Terms & Conditions or inappropriate, which includes but is not limited to items or racks that are stained, broken, damaged, torn, vulgar, have an odor, or are otherwise inappropriate in any other way. Opened or expired food and beauty products will be disposed of immediately.
9. Rack Take Down: Consignor must remove all his/her/their inventory items on the last day of the Consignment Period, which is the Friday, following his/her/their Rack Setup, between 7 p.m. and 8 p.m. If Consignor fails to take down the assigned rack during this period, La Segunda will assess a $10 Take Down Fee. If Consignor fails to retrieve his/her/their inventory items by the following Friday at 7 p.m., ownership and title of the unclaimed inventory items shall transfer to La Segunda, which may dispose of such items at its sole discretion.
10. Tagging Supplies: The Consignor agrees that a $5 dollar Fee will be taken out of payout to subsidize Tagging Supply costs and payout transaction fees. The Consignor understands that the amount of Tagging Supplies used will not impact this Fee, even if Consignor does not use any of the Tagging Supplies provided by La Segunda.
11. Rack Guarantee: La Segunda offers credit t up to the amount the Consignor paid for his/her/their booking if the Consignment Commission is less than what the Consignor paid for the booking, if the following criteria are met: (1) Consignor setup rack between 9am and 11am on the first day of the Consignment Period; (2) Consignor applies at least a 50% discount on his/her/their rack no later than Thursday during their Consignment Period; and (3) Consignor takes down rack between 7pm and 8pm at the end of their Consignment Period.
12. Missing or Damaged Items: While La Segunda will take all reasonable steps to safeguard Consignor’s inventory items, Consignor indemnifies La Segunda for any lost, stolen, damaged or missing inventory items. Consignor assumes all risks of the consignment and agrees to not hold La Segunda liable in any way for loss associated with this consignment. Any item found to have a defect that was not discovered at the time of drop off may be removed from the sales floor. No other warranty is valid, except as given in writing.
13. Condition of Acceptable Items: Consignor agrees that all inventory items must be in new or like-new condition. Any items with odors, stains, tears, fading, broken zippers, missing or broken buttons, not in working order, or similar issues are not acceptable and will be taken down and discarded at La Segunda’s reasonable discretion. Counterfeit items are not allowed to be sold at La Segunda. Items sold using a brand name or a brand logo must be original and made by the brand or manufactured on their behalf. Counterfeit items and sellers will be reported to authorities and sellers forgo any future of selling with La Segunda if they are found to be illegally selling counterfeit items.
14. Discounts: During the Consignment Period, Consignors may utilize La Segunda’s discount options of 25% off, 50% off, 75% off, and 90% off. These discounts apply to all items in Consignor’s rack. Any discount added will carry over to the following day, unless a greater discount is chosen for the following day, through the end of the Consignment Period. Once a discount is chosen, going down to a lower discount the following day or later in the week is not an option. Discounts are only allowed to remain the same or increase as the week moves forward. Occasionally “NO DISCOUNT” stickers provided by La Segunda may be used. Because taking off the discount is a manual transaction done by employees at checkout once the rack has been discounted, there is room for error. La Segunda employees will do their best to take off the discount when this sticker is properly placed. “NO DISCOUNT” stickers must be placed on the side of the tag where the price has been written. Only “NO DISCOUNT” stickers provided by La Segunda will be recognized as valid. Once an item has been sold, La Segunda will not reimburse sellers for items claimed were sold at a discount and should not have been.
15. Cancellations/rescheduling: Consignor can reschedule at no cost if racks are rescheduled by Wednesday night prior to their booking. Starting Thursday before their rental period, reschedules will be assessed a $10 fee per rack. Rack bookings are non-refundable. If a consignor does not set up Saturday morning and does not respond to our attempts to reach out and see if they are still planning on setting up during their rental week by Saturday evening, La Segunda reserves the right to sell their Rack to another consignor for that rental period.
16. Consignor’s Representations: The Consignor warrants that he/she/they is/are the lawful owner(s) of the inventory items and voluntarily consigns them to La Segunda pursuant to the terms of this Agreement.
17. Store closures during Consignment Period: La Segunda has the right to close for any reason at any time for reasons including but not limited to: Acts of God, inclement weather, shortage of staff, electrical, power or internet failure, etc., and shall not be liable for additional compensation to Consignors.
18. Severability: If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable in any respect, or enforceable only if modified, such finding shall not affect the validity of the remainder of this Agreement, which shall remain in full force and effect and continue to be binding on the Parties.
19. No Waiver: La Segunda’s failure to insist in any one or more cases upon the performance of any provision of this Agreement or to enforce any term of this Agreement shall not constitute waiver of this Agreement or any of its terms.
20. Governing Law and Venue: Any dispute arising from this Agreement or the relationship between the Parties as a result of this Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to conflicts of law principles. In the event any party to this Agreement must initiate any action or proceeding against another party pursuant to the terms of this Agreement, such action must be brought exclusively in any court of competent jurisdiction in Wisconsin.
21. Attorneys’ Fees and Costs: In the event La Segunda is required to enforce this Agreement in any forum, formal or informal, Consignor agrees to pay La Segunda’s costs and expenses, including reasonable attorneys’ fees, required to be incurred by Consignor’s breach of this Agreement.
22. La Segunda reserves the right, at its sole discretion, to modify or replace these Terms and Conditions at any time.
23. Entire Agreement: This Agreement constitutes the entire agreement and understanding between the Parties regarding the matters contained herein and supersedes any and all prior or contemporaneous agreements and understandings between the parties, whether oral or written.
